Cain Velasquez’s Attorney Plans Motion to Delay Trial

Velasquez’s attorney signals unpreparedness, plans to request trial delay.

Former UFC heavyweight champion Cain Velasquez is set to stand trial on September 9 for attempted murder. However, his attorney Renee Hessling has indicated that a motion to delay the trial is forthcoming.

Readiness and Continuance

During a trial readiness hearing in Santa Clara County Court, Hessling informed Judge Elizabeth Peterson that she is not prepared for a September trial date.

“I would indicate that I am not ready for trial in September,” Hessling stated. “I have not filed a 1050. As the date gets closer, if I am still not ready, I will file a 1050 that outlines the good cause reasoning.”

A 1050 is a request for continuance in legal proceedings. The court will decide on this motion at a later date, but for now, the trial remains scheduled for September 9 at 8:35 a.m. local time. Velasquez is required to appear in court if the date remains unchanged.

Incident Details and Charges

Velasquez, 41, was arrested on February 28, 2022, after a high-speed chase targeting Harry Goularte, accused of sexually abusing Velasquez’s son. During the chase, Velasquez allegedly fired shots into Goularte’s vehicle, hitting Goularte’s stepfather, Paul Bender, causing non-life-threatening injuries. Goularte faces charges of lewd acts with a child, and his trial is set for July 17.

Legal Proceedings and Current Status

While awaiting trial, Velasquez was initially held without bail but was later released on a $1 million bail in November 2022 after spending over eight months in custody. He has since resumed coaching at the American Kickboxing Academy in San Jose and participated in professional wrestling events.

Both defense and prosecution have discussed a possible plea deal, but no agreement has been reached. If convicted on all charges, Velasquez faces a potential life sentence.

This case continues to develop as Velasquez’s legal team gathers more evidence and prepares for potential trial proceedings.
